Win A Football Shirt Promotion - Terms and Conditions

By entering this “Win A Football Shirt” Promotion (the “Promotion”), you agree to be bound by these terms and conditions (the “Terms”). City Plumbing Supplies Holdings Limited, company number 02489546, registered addressHighbourne House Eldon Way, Crick Industrial Estate, Crick, Northampton, United Kingdom, NN6 7SL (the “Business”) is the promoter of this Promotion (the “Promoter”).

The Promoter reserves the right to amend these Terms from time to time where it reasonably considers it necessary to do so. Reasonable notice of such changes will be given where possible.

This Promotion will run from 12.01 BST on 1st December 2022 to 23:59 BST 19th December 2022. (the “Promotional Period”).

The Promotion is open to all customers who download the City Plumbing App (the APP) onto their mobile device within the Promotional Period and purchase one or more products from the Business using the APP within the Promotional Period (a Qualifying Purchase), and provided customers are:

In entering the Promotion, you confirm that you are eligible to do so. 

 A Qualifying Customer is only permitted one entry in the Promotion.

Purchases invoiced and not paid in full will not qualify.

There are nine (9) 2022 football shirts (“the Prizes”) available to win by Qualifying Customers who have made a Qualifying Purchase and are entered into the Promotion. All entries into the Promotion will be entered into a prize draw at the end of the Promotional Period and the winners will be chosen by random supervised by an independent person by 31st January 2023.  

The Prizes are supplied by the Promoter  and are subject to the following conditions:

The Promoter reserves the right to substitute the Prize with another reward without giving notice.

Qualifying Customers will be notified by the Business by e-mail and/or telephone (the “Notification”) if they have won a Prize following the prize draw (“the Winners”) and asked  which participating country’s football shirt they would like to receive and the correct size for their Prize. Only 2022 shirts from the participating countries will be available to choose for the Prizes. The Prizes will be available to collect from the Winner’s local branch once a collection date has been notified to the Winner.  

The Promoter reserves the right to amend this date without notice.

Qualifying Customers are responsible for maintaining their correct e-mail address and collection branch details with the Promoter. The Promoter will not be responsible if the Notification is sent to incorrect email addresses or if a Prize is sent to an incorrect branch, where the Qualifying Customers have failed to provide correct or up-to-date information.

All customers who make a Qualifying Purchase will be automatically entered into the Promotion. The Promoter will only process your personal information as set out in the Privacy Policy at https://www.cityplumbing.co.uk/privacypolicy. The Promoter reserves the right to use your personal information to contact you if you are a Winner to determine (i) what size football shirt you require, (ii) which branch you would like to collect it from and (iii) to notify you when it will be available for collection.

The Promoter reserves the right to cancel or amend the Promotion and these Terms where it becomes necessary to do so.

The Promoter shall not be liable for any failure to comply with these Terms where the failure is caused by something outside its reasonable control. Such circumstances shall include, but not be limited to, acts of God, adverse weather, fire, flood, computer virus, mobile phone failures, pandemic or the impact of pandemic, bugs, sabotage, strike, industrial dispute, war, hostilities, political unrest, riots, civil commotion or unrest, terrorism or supervening legislation. Accordingly, the Promoter may at its absolute discretion vary or amend the Promotion and the Qualifying Customer agrees that no liability shall attach to the Promoter as a result.

Insofar as is permitted by law, the Promoter or its agents will not in any circumstances be responsible or liable to compensate the Winner or accept any liability for any loss, damage, personal injury or death occurring as a result of the Prize except where it is caused by the negligence of the Promoter or its agents or that of their employees. The Promoter cannot be held liable for Prizes which are lost, stolen, damaged or defaced. Your statutory rights are not affected.

The Promoter shall under no circumstances whatsoever be liable to the Qualifying Customer in respect of this Promotion, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for any indirect or consequential loss arising under or in connection with the Promotion. 

The Promoter’s total liability to the Qualifying Customer in respect of all other losses arising under or in connection with any entry made under the Promotion and/or the Prize, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall in no circumstances exceed the value of the Prize granted to the Qualifying Customer. 

The Winners agree to the use of their name, image and entry in any marketing publicity. Any personal data relating to Winners will be used in accordance with the Promoter’s privacy policy.

The Winner acknowledges that the Promoter and/or other members of the Highbourne Group (Highbourne Group shall mean the Business, the ultimate parent company of the Business and any such parent company’s subsidiary from time to time (as defined in s1159 Companies Act 2006)), are the owner of any and/or all Intellectual Property Rights relating to the names, logos, trade-marks, products, services, get-up, trade dress, labels, stickers, promotional leaflets, flyers and posters used in the Promotion from time to time.

The Promoter's decision regarding promotion matters will be final and no correspondence or discussion will be entered into.

These Terms are governed by the laws of England and Wales and are subject to the exclusive jurisdiction of the English courts.

The Promoter excludes all liability for taxes relating to the Prizes and any tax liability arising from the provision of the Prizes will be the sole responsibility of the Winners.

Entry into the Promotion will be deemed as acceptance of these Terms.
