G Nest “Win A Smart Home” Promotion August 2022 - Terms & Conditions

Google Nest Promotion
By entering this “Win A Smart Home” Promotion (the “Promotion”), you agree to be bound by these terms and conditions (the “Terms”). City Plumbing Supplies Holdings Limited, company number 02489546, registered addressHighbourne House Eldon Way, Crick Industrial Estate, Crick, Northampton, United Kingdom, NN6 7SL (“CPS”) is the promoter of this Promotion (the “Promoter”).
The Promoter reserves the right to amend these Terms from time to time where it reasonably considers it necessary to do so. Reasonable notice of such changes will be given where possible.
This Promotion will run from 12.01 BST on 1st August 2022 to 23:59 BST 31st August 2022 (the “Promotional Period”).


The Promotion is open to the account holders of credit accounts or trade cash card customers of the Promoter (which trades as CPS and Plumbing Trade Supplies (“PTS”)) provided they are based or resident in the UK (the “Qualifying Customers”).
The Promotion is not open to:
  1. Merchants (all resellers and/or competitors of CPS and/or PTS); 
  2. Public Organisations including Housing Associations and Local Authorities; 
  3. British Gas;
  4. BOXT;
  5. Customers with internal and/or external contract support; and
  6.  Employees of the P&H Group. P&H Group shall mean CPS, the ultimate parent company of CPS and any such parent company’s subsidiary from time to time (as defined in s1159 Companies Act 2006), and any member of their household.
In entering the Promotion, you confirm that you are eligible to do so. 

How to participate

To qualify for the Promotion, Qualifying Customers must purchase at least £200 (ex VAT) of Google Nest Smart products (“Qualifying Goods”) either in-store or online during the Promotional Period (the “Qualifying Purchase”). Each Qualifying Purchase entitles the Qualifying Customers to receive 1 entry into the Promotion. The number of entries a Qualifying Customer can make is not limited.

Purchases invoiced and not paid in full will not qualify.
All purchases of the Qualifying Goods and accounts will be verified by CPS and the Supplier.
Purchases of Qualifying Goods that have been returned within 30 days after the end of the Promotional Period will not be eligible.

The Rewards

There are three types of prizes available to Qualifying Customers who have made a Qualifying Purchase and are entered into the Promotion. All entries into the Promotion will be entered into a prize draw at the end of the Promotion Period. The prize draw will dictate which Qualifying Customers win the first, second and third prizes as set out below:
(i) One eligible Qualifying Customer who has made a Qualifying Purchase will receive a Nest Learning Thermostat, Nest Hub Gen 2, Nest WiFi Router & Point, Nest Doorbell Pro, Nest Cam Battery & Nest Cam Indoor (“1st Prize”).
(ii) Three eligible Qualifying Customers who have made a Qualifying Purchase will receive a Nest Thermostat E, Nest Hub Gen 2 & Nest Doorbell Pro (“2nd Prize”). 
(iii) Ten eligible Qualifying Customers who have made a Qualifying Purchase will receive a Nest Thermostat E (“3rd Prize”). 
1st Prize, 2nd Prize and 3rd Prize are the rewards (the “Rewards”).
The Rewards are supplied by Google Commerce Limited, a company registered in Ireland with the company registration number 512080 and its registered address at Barrow Street 4, Dublin, Ireland (the “Supplier”) and are subject to the following conditions:
(i) no cash or other alternatives will be offered;
(ii) the Rewards are not transferable;
(iii) the Rewards are subject to availability; and
an eligible Qualifying Customer may only receive one of either: the 1st Prize, 2nd Prize or 3rd Prize and may not receive more than 1 of any such prize.
The Promoter reserves the right to substitute the Rewards with another reward without giving notice.

Distributing the Reward

Qualifying Customers will be notified by CPS by e-mail and/or telephone (the “Notification”) if they have won a prize following the prize draw. The Qualifying Customers will be notified after 1 October 2022. The Rewards will be available to collect from the Supplier at a CPS or PTS branch from week commencing 10th October 2022 until 31st October 2022 once a Notification has been received and you have agreed your collection date with the Supplier. 
The Promoter reserves the right to amend this date without notice.
Qualifying Customers are responsible for maintaining their correct e-mail and collection branch details with both the Promoter and the Supplier. The Promoter and the Supplier will not be responsible if the Notification is sent to incorrect email addresses or if a Reward is sent to an incorrect branch, where the Qualifying Customers have failed to provide correct or up-to-date information.

Data Protection and Publicity

The Promoter will only process your personal information as set out in the Privacy Policy at
Qualifying Customers should note that by entering into this Promotion, they agree that their name, email address, telephone number and preferred CPS or PTS branch for Reward collection will be shared with the Supplier. The Supplier may use this information to contact Qualifying Customers for the purposes of the Promotion, subject to the Supplier having the necessary consents. The Promoter reserves the right to cancel or amend the Promotion and these Terms where it becomes necessary to do so.
The Promoter shall not be liable for any failure to comply with these Terms where the failure is caused by something outside its reasonable control. Such circumstances shall include, but not be limited to, acts of God, adverse weather, fire, flood, computer virus, mobile phone failures, bugs, sabotage, strike, industrial dispute, war, hostilities, political unrest, riots, civil commotion or unrest, terrorism or supervening legislation. Accordingly, the Promoter may at its absolute discretion vary or amend the Promotion and the Qualifying Customer agrees that no liability shall attach to the Promoter as a result.
Insofar as is permitted by law, the Promoter or its agents will not in any circumstances be responsible or liable to compensate the Qualifying Customers or accept any liability for any loss, damage, personal injury or death occurring as a result of the Reward except where it is caused by the negligence of the Promoter or its agents or that of their employees. The Promoter cannot be held liable for Rewards which are lost, stolen, damaged or defaced. Your statutory rights are not affected.
The Promoter shall under no circumstances whatsoever be liable to the Qualifying Customer in respect of this Promotion, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for any indirect or consequential loss arising under or in connection with the Promotion. 
The Promoter’s total liability to the Qualifying Customer in respect of all other losses arising under or in connection with any entry made under the Promotion and/or the Reward, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall in no circumstances exceed the value of the Reward. 
The Qualifying Customers agree to the use of their name, image and entry in any marketing publicity. Any personal data relating to Qualifying Customers will be used in accordance with the Promoter’s privacy policy.
The Qualifying Customer acknowledges that the Promoter and/or other members of its group of companies are the owner of any and/or all Intellectual Property Rights relating to the names, logos, trade marks, products, services, get-up, trade dress, labels, stickers, promotional leaflets, flyers and posters used in the Promotion from time to time.
The Promoter's decision regarding promotion matters will be final and no correspondence or discussion will be entered into.
These Terms are governed by the laws of England and Wales and are subject to the exclusive jurisdiction of the English courts.
The Promoter and Supplier excludes all liability for taxes relating to the Reward and any tax liability arising from the provision of the Reward will be the sole responsibility of the recipient/Qualifying Customer of the Reward.
Entry into the Promotion will be deemed as acceptance of these Terms.
